IHC bars FBR from recovering tax from M/s Petroleum Technology Solutions

ISLAMABAD: A single bench of the Islamabad High Court (IHC) has decided the tax matter filed by M/s Petroleum Technology Solutions (Private) Limited and barred the Federal Board of Revenue (FBR) from recovering outstanding tax amount of Rs 6.2 million from the company.

Justice Aamer Farooq of the IHC also directed the FBR’s filed office, Regional tax Office, Islamabad, to decide the appellant’s appeal within 30 days and submit a report to the IHC administration.

Justice Aamer Farooq decided the matter in favor of the appellant who had challenged the Regional Tax Office’s notice of Rs 6.2 million.

The Regional Tax Office (RTO) had issued the notice for tax year 2015 in head of sales tax under provisions of Sales Tax Act, 1990. The petitioner had also submitted that hearing on its stay application was being delayed without any lawful ground.

The appellant had made FBR, and officers of RTO including chief commissioner, assistant chief commissioner inland revenue and commissioner inland revenue (appeals) as respondents in the case.
