IHC bench directs Large Taxpayers’ Unit to decide plea of DHA in 60 days

ISLAMABAD: The Islamabad High Court (IHC) on Thursday barred the Large Taxpayers’ Unit (LTU) from recovering outstanding tax of Rs 1,210,253,332 from Defence Housing Authority.

A single bench of the IHC comprising Justice Aamer Farooq heard the case and also directed the LTU to decide the application of the DHA within 60 days and submit a report before the bench.

The appellant had challenged a recovery order of the LTU dated March 25, 2016. The LTU had issued the order, stating that the outstanding tax of Rs 1,210,253,332 was recoverable for the tax year 2013. The order was issued under provisions of Income Tax Ordinance, 2001.

Federal Board of Revenue (FBR), LTU’s chief commissioner, commissioner Inland Revenue, commissioner Inland Revenue (Appeals), assistant commissioner Inland Revenue and ATIR were made party in the case.
