IHC directs ATIR to decide appeal filed by M/s Wateen Telecom within 45 days

ISLAMABAD: A single bench of the Islamabad High Court on Tuesday directed the Appellate Tribunal Inland Revenue (ATIR) to decide the appeal filed before it by M/s Wateen Telecom Limited within 45 days.

Justice Aamer Farooq of the IHC issued these directives, adding that the FBR  must abstain from recovering outstanding tax amount of Rs 18,781,191 from the appellant.

The court was hearing the petition filed by M/s Wateen Telecom Limited and disposed it of with the said directions.

The appellant had challenged the Large Taxpayers’ Units’s order, dated June 22, 2015, for recovering the said amount in head of outstanding taxes for the year 2009. The LTU had issued the order under Sections 122(11) and 122(5) of the Income Tax Ordinance, 2001.

The Federal Board of Revenue (FBR), LTU’s chief commissioner, Inland Revenue commissioner , Inland Revenue (Audit) commissioner and the ATIR were made respondents in the case.
