ISLAMABAD: Justice Aamer Farooq of the Islamabad High Court (IHC) has directed the Appellate Tribunal Inland Revenue (ATIR) and Large Taxpayers’’ Unit’s deputy commissioner to decide the appeal filed by M/s TNB Liberty Power Limited within 60 days.
The IHC judge issued these directives while concluding the hearing of a tax reference in which the appellant had challenged the demand, dated-March 8, 2015, of Rs 2,690,553,152 created by the LTU’s deputy commissioner inland revenue for the fiscal year 2011-12.
The appellant had challenged the order before the court which was disposed on Friday. Chief Commissioner Inland Revenue LTU, Islamabad, ATIR, and Federal Board of Revenue were also made respondent in the case.
During the course of proceedings, the court also directed the LTU’s commissioner Inland Revenue (enforcement) to abstain from recovering outstanding Rs 2,690,553,152 in account of different duties and taxes till the finalization of appellant’s appeal before the ATIR.
Earlier, the appellant had exhausted 60 and 90 days stay on the matter granted by the ATIR. The appellant had prayed the court to directed ATIR to decide the fate of its appeal filed there.
