IHC issued directives to FBR on petition filed by M/s Nokia Solutions and Networks

ISLAMABAD: Hearing tax references filed against the Federal Board of Revenue (FBR), the Islamabad High Court (IHC) issued directives to the board during the fourth week of October.

The IHC benches issued these directives while hearing cases filed by Nokia Solutions and Networks Pakistan (Private) Limited and M/s Zhongxing Pakistan (Private) Limited. The former’s case was disposed of while the later one was adjourned.

Justice Miangul Hassan Aurangzeb disposed of a tax reference filed by Nokia Solution and Networks Pakistan Private Limited, seeking restrictions for the Federal Board of Revenue from recovering Rs 3,643,291. The bench directed department to address grievances of the appellants.

Nokia Solution and Networks Pakistan Private Limited had challenged a tax recovery claim amounting to Rs 3,643,291 issued by field office of Federal Board of Revenue (FBR).

Federal Board of Revenue (FBR), officers of LTU including commissioner Inland Revenue, deputy commissioner Inland Revenue and commissioner Inland Revenue (Appeals) were made respondent in the case.

Justice Aamer Farooq heard the case filed by M/s Zhongxing Pakistan Private Limited. It had sought restrictions for Federal Board of Revenue from charging outstanding tax amount of Rs 71,342,536.

Justice Aamer Farooq issued notices to respondents in the case. The court has directed the parties to submit their reply before the court in the case filed by M/S Zhongxing Pakistan Private Limited.

M/s Zhongxing Pakistan Private Limited had filed the case seeking restrictions for Large Taxpayers Unit, Islamabad about recovering outstanding tax amount or making any other coercive move prior to court’s directions on the issue.

Federal Board of Revenue (FBR), officers of LTU including commissioner Inland Revenue and commissioner Inland Revenue (Appeals) were made respondent in the case.
