IHC merges cases against FBR’s audit policy

ISLAMABAD: Justice Amer Farooq of Islamabad High Court (IHC) on Wednesday heard the case in which the Federal Board of Revenue’s (FBR) policy to select business entities for an audit through a computer-based random balloting has been challenged.

IHC judge heard the matter filed by M/S OMV Maurice Energy Limited and connected the cases with another case of similar nature in which FBR policy was challenged separately and sent the matter in office for scheduling of next date of hearing.

The petitioner, M/S OMV Maurice Energy Limited had challenged the policy questioning selection method used in it and criterion set for used for entitling audit through the policy.

The appellant had prayed the court to declare the policy ultra vires and violation of the Constitution as it often undermines law and equality before the law.

Moreover, the petitioner prayed the court to declare audit selections made under the said policy as illegal and without lawful grounds and also the orders, notices and show cause notices issued under the impugned policy.

The appellant had named FBR Audit member and officers of LTU, Islamabad as respondent in the petition.

It is pertinent to mention that LTU alone had selected 75,870 corporate and non-corporate entities for audit under the said policy in 2015.
