The appellant had challenged confiscation of goods allegedly smuggled by M/s Smart Zone Private Limited and some were dumped in godown near Lahore. Interestingly, the Customs Appellate Tribunal had set aside decision of departmental adjudication by rejecting the allegations casted by the DGI&I.

According to DGI&I, these items included: Samsung refrigerators, air conditioners, LED TVs, microwave ovens, and washing machines.

Department also estimated that the company had smuggled goods of worth Rs78,774,606, involving evasion of duty and taxes of Rs50,872,654.

M/s Smart Zone Private Limited had prayed the court to direct the department’s authorities that they must quash the proceedings against company being made in account of said case after the tribunal had decided in favor of the appellant.

Further it had demanded the court to direct the department to provide documents on basis of which liability is being sought by the department.
