IHC reserves verdict on tax reference filed by M/s Liberty Power

ISLAMABAD: A division bench of the Islamabad High Court (IHC) on Friday reserved a decision on a tax reference filed by M/s Liberty Power Limited.

The IHC division bench comprising Justice Noor ul Haq N Qureshi and Justice Athar Minallah reserved the decision after hearing the arguments from sides.

Through the petition, M/s Liberty Power Limited had challenged recovery notice of Rs 9.223 million issued by Large Taxpayers’ Unit (LTU), Islamabad.

The appellant had challenged a recovery order of Large Taxpayers’ Unit, issued in May, 2016. LTU had issued the order stating the recoverable outstanding tax amount for the tax period of 2010-2012.

Federal Board of Revenue (FBR), LTU’s Commissioner Inland Revenue, Deputy Commissioner Inland Revenue, Deputy Commissioner Inland Revenue Enforcement and ATIR were made party in the case.

The appellant had prayed the court to set aside the decision announced by ATIR and direct the LTU not to recover any amount taking any coercive action following the show cause notice.
