Importer moves SHC seeking order for set aside FIR

KARACHI: An importer has approached the Sindh High Court (SHC) against lodging first information report (FIR) for allegedly smuggling of mobile phones and electronics goods challenging filing of first information report (FIR).

On 3 April 2020, counsel for the accused namely Muhammad Naveed moved a petition and argued that his client came from abroad and imported different types of mobile phones and other electronics items according with law, however, he was stopped at Quaid-e-Azam International Airport Karachi by customs officials and without any lawful reasons he was taken into customs custody.

He said that customs officials also seized Samsung branded mobile phones, TV accessories and other electronics goods, first information report (FIR) has been lodged and applicant/ accused was sent to jail by Customs Court Karachi.

He said that interim charge sheet has been submitted by investigation officer in which no concrete evidence has been showed against the petitioner.

Citing chairman Federal Board of Revenue, collector of Customs Quaid-e-Azam International Airport, and others officials of customs department as respondents, petitioner pleaded the court to declare that act of the respondent is illegal, mala fide and arbitrary.

He further pleaded the court to set aside impugned first information report (FIR) and restrain them from taking any further adverse action against the petitioner till final order.
