KARACHI: Jahan Khan, son of Qamaruddin, moved the Sindh High Court (SHC) seeking release order of three white spirit tankers imported from Iran via Taftan border but seized by customs officials.
On November 8, 2018, counsel for the petitioner stated in his constitutional petition that petitioner has imported three vehicles of while spirit from Iran via Taftan border and after due course of formalities the petitioner produced its goods declaration before the customs authorities as Quetta Dry Port and customs authorities also sent the samples of goods for test report from PCSIR Laboratories Quetta, where the laboratories confirmed that the goods were as white spirit.
He argued that after the payment of goods declaration, goods were sent to Karachi, however, he informed the officials that DG of Intelligence and Investigation FBR Hyderabad illegally seized the above mentioned vehicles along with goods/white spirit and in the absence of owner, the samples sent for laboratory test which is in violation of section 199 of the customs act, only to get ambiance report in their favor.
He further stated that physical possession of the goods was taken over by the respondents, hence the petitioner has no access with the vehicles or goods from the day of seizing of goods.
Citing Chairman Federal Board of Revenue, DG I&I-FBR Hyderabad and others as respondents, he prayed the court to declare that act of the respondents as illegal, mala fide and arbitrary.
He also pleaded the court to direct them to release his vehicles along with goods and restrain them from taking any coercive action against the petitioner till final order in this petition.
