LHC bars FBR from recovering Rs 253.4m tax from Lesco

LAHORE: Lahore High Court (LHC) has barred Federal Board of Revenue (FBR) from recovering Rs 253.4 million tax from Lahore Electric Supply Company (Lesco) for three days.

Justice Shams Mehmood Mirza passed the orders on a petition filed by the Lesco challenging the tax notices for recovery of Rs 253.4 tax.

Earlier, Lesco’s counsel arguing before the court submitted that electricity distribution companies were not included among those companies which were bound to pay tax on their income and sales. But, despite the fact, the Inland Revenue imposed 253.4 million tax in 2012 and had issued notices for the recovery of the same, he added.

He contended that the FBR wanted to recover the tax forcefully and it was feared that the bank accounts of the Lesco would be seized. He pleaded the court to dismiss notices issued by the FBR for the purpose.

The court after hearing arguments disposed of the petition and stayed the FBR from recovering the tax for three days. The court directed the Lesco to approach Appellate Tribunal Inland Revenue.
