LAHORE: The Lahore High Court (LHC) has barred Inland Revenue (IR) additional commissioner and deputy commissioners from issuing sales tax notices to the taxpayers, as only IR commissioners are authorised to issues the notices.
Justice Shahid Kareem heard the case filed by the Hamza Nasir Wires in which the counsel of appellant Ajmal Khan argued before the court that under Section 30 of Sales Tax Act, additional commissioners and deputy commissioners cannot send notices to the taxpayers, adding that only commissioners are authorised to send notices to the taxpayers under the law.
He further said that the additional commissioners and deputy commissioners were sending sales tax notices to the taxpayers by violating the Sales Tax Act.
He asked that court may stop the additional commissioners and deputy commissioners from sending notice to the taxpayers because under the law these officers have no authority to sent notices to the taxpayers.
After hearing the arguments from the appellant, the LHC has barred the official, besides sending notice to the Federal Board of Revenue (FBR) and sought reply from the board within three weeks.
