During the hearing, petitioner’ counsel arguing before the court submitted that a special judge (Customs) and LHC customs appellate bench had rejected the bail pleas of the accused which were being assailed through the present appeal.

He said that LHC division bench had jurisdiction to hear appeal against the verdict of customs appellate bench but the registrar’s office raised objection on plea that it was not maintainable.

The counsel pleaded the court to remove objection and issue directions for fixing the matter before a division bench.

The court agreed with arguments of the counsel and directed to fix the matter before a division bench after removing the objection.

Ayyan Ali through his present plea challenged the verdicts of special judge (customs) and LHC customs appellate bench on his bail plea.

She said that a case had been registered against her on charges of smuggling US $ 506,800 to Dubai.

She submitted that she brought the money at Benazir International Airport to deliver it before departure to her brother who was coming from Dubai.

Ayyan said as soon as she entered lounge, the official found her up in the false case despite the fact that she had not passed through customs counter and received boarding card.

She contended that mere bringing of some dutiable goods/currency to airport does not constitute offence.
