KARACHI: A two-member bench of the Sindh High Court (SHC) issued notices to the customs department and deputy attorney general of Pakistan and directed them to file their respective para wise comments on a constitutional petition filed by M/s Bin Bakar Enterprises against allegation of mis-declaration and show-cause notice issued by Deputy Collector of Customs Appraisement East.
On 7 September 2021, a two-member bench, headed by Justice Shafi Muhammad Siddiqui heard the matter.
During the hearing, counsel for the petitioner argued that counsel is a lawful importer of body lotions, perfumes, toilet spray etc and during the course of business, petitioner has imported a consignment comprising body lotions, perfumes, toilet spray, body spray, shower gels etc and filed goods declaration according with law.
He further argues that petitioner was shocked when allegations were fixed upon the petitioner for mis-declaration and show cause notice also was issued to the petitioner without any justification and lawful authority.
Counsel states that petitioner has imported the above mentioned goods according with law and no mis-declaration has been made by the petitioner and action of the respondents is totally unlawful.
Citing Chairman Federal Board of Revenue, Collector of Customs Appraisement East, Deputy Collector of Customs and others as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
He further pleaded the court to set aside impugned show cause notice and direct them to release petitioner’s consignment immediately and restrain them from taking any adverse action against the petitioner till final order in this petition.
