KARACHI: A two-member bench of the Sindh High Court (SHC), headed by Justice Irfan Sadat Khan sought explanation from customs officials that why para wise comments have not been filed within the stipulated period on a constitutional petition filed by M/s Pakistan Agency Karachi
On 18 January 2022, during the hearing, Syed Fauzia Murad Adeel advocate for petitioner, Javad Hussain advocate holds brief for Ms Masooda Siraj, Kafeel Ahmed Abbasi, deputy attorney general of Pakistan appeared before the bench.
Counsel for the petitioner argued that being aggrieved and dissatisfied from unlawful suspension of customs agents license no 603 of clearing & forwarding of goods and baggage without providing opportunity of being heard and without passing any judicial order.
He further added that petitioner having a carrying style of M/s Pakistan Agency Karachi and the role of the petitioner is very limited as clearing and forwarding agent and customs officials has suspended its clearing and forwarding license without showing any lawful reason.
Citing Secretary Revenue Division, Collector of Customs Appraisement East, Deputy Collector of Customs Licensing as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
He also pleaded the court to direct them to restore petitioner clearing and forwarding license and restrain them from taking any adverse action against the petitioner till final judgment in this petition.
