KARACHI: A two-member bench of the Sindh High Court (SHC), headed by Justice Shafi Muhammad Siddiqui directed customs officials to file their respective para wise comments on a constitutional petition filed by M/s Yasir Enterprises against suspension of its license of clearing and forwarding.
On 21 December 2021, Zain Ali Jatoi, advocate for petitioner, Kafeel Ahmed Abbasi, deputy attorney general, Hussain Bohra, assistant attorney general, Masooda Siraj advocate for customs, Tariq Aziz, principal appraiser Port Muhammad Bin Qasim, Danish, Investigation officer of Port Muhammad Bin Qasim appeared before the court.
Khalid Rajpar advocate filed vakalatnama on behalf of collector of Customs Port Muhammad Bin Qasim and other which was taken on court record.
After the hearing, court passed order that “it is claimed by Zain Ali Jatoi advocate that it is on their behalf customs officials suspended the license of the petitioner, let such material available with No 2 & 3 with para wise comments be filed till the next date of hearing, failing whereof appropriate order of the restoration of the license of the petitioner shall be passed who has only acted as a clearing & forwarding agent of the petitioner. Notice be repeated upon respondent no 4”.
Citing Secretary Finance, Collector of Customs Port Muhammad Bin Qasim, Deputy Collector of Customs Intelligence Unit, Collector Port Muhammad Bin Qasim, Deputy Collector Licensing Section Customs Port Muhammad Bin Qasim and others as respondents, petitioner pleaded the court may declare that action of the respondents, suspension of petitioner clearing agent license/ user ID/ NTN is outright illegal, without jurisdiction and mala fide.
Petitioner pleaded the court to direct them to restore its clearing agent’s license and restrain them from taking any adverse action against the petitioner till final order in this case.
