KARACHI: Custom Court Judge Syed Faiz Rasool Rashdi has granted pre-arrest bail to a suspect, Muzammil Khan, proprietor of M/s MR Enterprises. The suspect was booked in a case of mis-declaration.
During the hearing, counsel for the suspect filed an application for pre-arrest bail and submitted that the applicant is innocent and falsely implicated in this case. The counsel said that the suspect is ready to face trial, but fears arrest and the court may grant him pre-arrest bail.
After the arguments, the court granted pre-arrest bail to Muzammil Khan against surety of Rs 100,000 and directed him to join investigation and appear before the court on the next date of hearing.
According to the prosecution, the customs authorities blocked an online consignment weighting 21.180 MT of imported goods as printed/ misprinted plastic film waste scrap imported from USA by the accused/ applicant. The consignment was declared/ assigned to gate staff of MCC Port Muhammad Bin Qasim Karachi on November 25, 2016. The consignment was assessed at Rs 8,96,195 and on payment of duty and taxes totaling Rs 442,329.
As per the FIR, during the examination, it was found to be comprised of printed plastic rolls, weighting 21.260 MT having brand of edible products. According to the S.NO 11 of appendix B to IPO 2013, misprinted plastic/ paper scrap, having brand of edible products, are importable only in completely cut into pieces from so that no piece contains the complete brand name. It was alleged in the FIR that plastic rolls can be used for packing of edible products after clearance from the customs.
The case was registered on December 9, 2016 by directorate general of Intelligence and Investigation (Customs Enforcement) Karachi under section 16, 32 (1) (2) & 79 (1) punishable under section 156 (1) (14) of the customs act, 1969.
