M/s A.B Traders moves SHC against assessment under VR No 1268(1)/2018

KARACHI: The Sindh High Court (SHC) issued notices to the Customs department and deputy attorney general, directing them to file their respective para wise comments on a constitutional petition filed by M/s A.B Traders against assessment of consignment of roller chain under Valuation Ruling No 1268(1)/2018 dated 07/03/2018.

On Tuesday, a two-member bench, headed by Justice Aqeel Ahmed Abbasi, was hearing the matter.

Earlier, counsel for the petitioner submitted that petitioner is engaged in the lawful import of roller chain and always fulfills all the formalities under the law. It imported a consignment of roller chain and filed goods declaration as per law; however, officials of the respondents are assessing the imported goods duty and taxes on the basis of Valuation Ruling No 1268 (1) /2018 dated 07/03/2018 issued by Director General of Valuation.

Citing Chairman Federal Board of Revenue, Chief Collector of Customs, South, Chief Collector of Customs West, Chief Collector of Customs East and Director General of Valuation as respondents, the petitioner pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.

He also pleaded the court to direct them to release the consignment according to law and restrain them from taking any coercive action against the petitioner till final order in this petition.
