M/s Al Chan Corp moves SHC against determination of valuation of polyurethanes

KARACHI: The Sindh High Court (SHC) has issued notices to customs authorities and deputy attorney general on a constitutional petition filed by M/s Al Chan Corporation, M/s Lasting Knits, M/s Silver Zone and M/s Orfit Shoes Industry against determination of valuation of polyurethanes of Chinese origin.

While the hearing of the petition, a two-member bench, comprising Justice Munib Akhtar and Justice Umer Sial, also directed them to file their respective para wise comments on the next date of hearing.

Earlier, counsel for the petitioners stated that they were the manufacturers of various types of foot-wears and import raw material, including polyurethanes, from different countries of the world. The counsel argued that they imported the above mentioned goods according to law, however, they were informed by the customs authorities that customs officials were assessing/ determining the values of polyurethanes of Chinese origin imported by the petitioners.

Citing Chairman Federal Board of Revenue, Director of Customs Valuation Customs Collectorate West as respondents, petitioners pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary, counsel further pleaded the court may direct them to release their consignments according with law.
