M/s Hamza Corporation moves SHC against enhancement of valuation of CBC coconut oil

KARACHI: The Sindh High Court (SHC) directed customs officials and deputy attorney general to file their para wise comments on a petition filed by Shaikh Javad Iqbal, proprietor of M/s Hamza Corporation challenging enhancement in valuation of foods items including CBC coconut oil.

A two-member bench, headed by Justice Aqeel Ahmed Abbasi, was hearing the matter on October 01, 2018.

During the hearing, counsel for the petitioner stated that petitioner is engaged in the lawful import of foods items including CBC coconut oil and always fulfills all the legal formalities.

He submitted that petitioner imported the above-mentioned goods and filed Goods Declaration (GDs) according with law; however, customs officials enhanced the valuation without lawful authority and seized its consignment illegally.

Citing Secretary Revenue Division, Collector of Customs Port Muhammad Bin Qasim, Deputy Collector of Customs Port Muhammad Bin Qasim and others as respondents, he pleaded the court to declare that act of the respondents illegal, mala fide and arbitrary.

Importer also pleaded the court to direct them to release its consignment immediately and restrain them from taking any coercive action against the petitioner till final order in this petition.
