M/s Kinijhar Int’l moves SHC for exemption of duty, taxes on LED bulbs etc

KARACHI: M/s Kinijhar International moved the Sindh High Court (SHC), seeking exemption of duty and taxes on consignments of LED bulbs etc as entitled under 5th schedule of the Customs Act 1969.

According to the details, counsel for the petitioner stated in its constitutional petition that the petitioner is engaged in the lawful business of import of LED bulbs etc and always fulfills all the liabilities properly.

He said that in rotten, petitioner imported consignment of LED Bulbs 12 watt, 15 watt, 18 watt, 25 watt 40 watt and other related goods and filed goods declaration under availing exemption as entitled under 5th Schedule of the Customs Act 1969.

He further informed the court that however, officials of the Customs Collectorate Appraisement West who has not accepted the assessment made by the petitioner on the pretext that the petitioner’s goods are not entitled for relevant exemption as per assessment.

Citing Chairman Federal Board of Revenue, Collector of Customs Collectorate Appraisement West, the Engineering Development Board Alternate Energy Department Board as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.

He also pleaded the court may declare that above mentioned goods are entitled under 5th schedule of the Customs Act 1969.
