M/s Pak Telecom Mobile moves SHC against detention of its consignment

KARACHI: M/s Pak Telecom Mobile Limited approached the Sindh High Court against detention of a consignment comprising “directional, antenna with accessorize and “RRU with Huawei International PTE Ltd seized by customs officials due alleging mis-declaration.

On August 30, 2019, counsel informed the court that his petitioner has undertaken import of telecommunication equipment containing “directional, antenna with accessorize and “RRU with Huawei International PTE Ltd, upon arrival of the said consignment the petitioner filed goods declaration which was truthfully declared the particulars of the consignment, including but not limited to the description and value thereof, the declaration made by the petitioner is duly supported by imported documents and has accordingly made payment of the duty and taxes to the respondents.

Counsel further argued that however, the consignment of the petitioner has been detained by the officers of customs department on the pretext that the petitioner has made an alleged mis-declaration vis-à-vis the value of the consignment. It is alleged by the officers of the respondents that the petitioner is involved in undervaluing the invoice/ transactional value of the consignment supplied by its vendor i.e. Huawei.

He submitted that petitioner approached the customs officials and tried to explain that since telecommunication equipment is imported is in huge quantities by the petitioner, its supplier i.e. Huawei offers exceptional commercial bargains and trade discounts/ setoffs due to bulk purchasing and, hence, the petitioner is able to negotiate a bargain in the final price, he further stated that entire industry importing telecommunication equipment from Huawei is offered similar trade discounts.

Citing secretary Revenue Division, Directorate General of Intelligence & Investigation (Customs) FBR, Collector Port Muhammad Bin Qasim as respondents, petitioner pleaded the court to declare that detention of the consignment is unlawful, illegal and direct the respondents to provisional release the impugned consignment of the petitioner.
