KARACHI: M/s Usmanco International approached the Sindh High Court (SHC) against detention of its consignments of I.V. Canola/ I.V Catheter imported from Turkey due to disputed valuation.

Counsel for the petitioner stated in his constitutional petition that petitioner is a proprietorship concern engaged in the commercial import of I.V. Canola/ I.V Catheter with and without stoppers from Turkey.

He further submitted petitioner is seriously aggrieved and highly prejudiced by the actions of the respondents in which they are assessing the imported consignments of I.V. Canola/ I.V. Catheter with and without stoppers from Turkey and demanding duties and taxes on the basis of the Valuation Ruling No 1316/ 2017 dated 16/08/2018, despite the fact that the impugned valuation ruling is not sustainable in the eyes of the law, being older than 90 days and has been challenged by the petitioner before Director Valuation.

He argued that determination and re-determination are still pending as the petitioner has sought provisional release of its consignments until revision and/ or rescission of the impugned valuation ruling, however, the respondents have refused such request on the basis of circular dated 22/11/207.

He further argued that petitioner is being unlawfully coerced to pay amounts of duties and taxes which are otherwise not leviable, failing which the petitioner is unable to take delivery of its lawfully imported goods.

Citing chairman Federal Board of Revenue, Chief Collector of Appraisement South and Appraisement East, Director Valuation Ruling and collector Port Qasim as respondents, petitioner pleaded the court may direct them to release its consignments immediately.
