Multan: ADC Fayaz Anwar issues ONO against plastic granules’ smugglers

MULTAN: The Pakistan Customs Collectorate of Adjudication has issued an Order-in-Original (ONO) in four cases of smuggled Iranian plastic granules worth Rs 6 million with the judgement of outright confiscation.

Additional Collector Fayaz Anwar heard the case and issued the ONO in the favour the Customs Intelligence and Investigation. The plastic moulding compound consignments were seized by the Customs Intelligence and Investigation, Multan.

Customs Intelligence seized the goods that comprised high-density polyethylene (HDPE) granules. The seized goods have high resistivity towards temperature like similar polymers that are used as raw material to make plastic articles.

These raw materials were notified through SRO 566(1)/2005 under Section 2(s) of the Customs Act, 1969.

As per the detail, the Customs field investigation unit Dera Ghazi Khan seized 800 bags of plastic granules loaded onto a truck with registration number TKB-439.

A case No 322/2014 was registered against the accused. Total customs duty liable on seized items was almost Rs 1.18 million, assessed by Multan Dry Port Principal Appraiser Sher Shah.

Similarly, intelligence also seized 725 bags from a truck registration no TKJ-735, 740 bags from a vehicle having registration no TKB-228 and 725 bags of plastic granules from a truck bearing registration number C-1497 in other operations in Multan region.

Cases No 53/2014 and 25/2014 were registered against the accused.

As a whole, 3,015 bags of plastic granules were recovered during customs’ operation against smuggled items that were bringing brought to the country through unauthorised routes in violation of sections 2(s) and 6 of the Customs Act, 1969.

The estimated customs duty tax on the 3015 bags of plastic granules was almost Rs 4 million.

The accused counsel tried to satisfy the courts on the point of law that the imports goods do not fall under provisions of Sections 2(S) of the Customs Act, 1969, and the seized goods were falling under the impugned goods ethylene having PCT Heading 27-13 and PVC polyvinyl chloride under PCT Heading 39-04, so it reflects that pre ethylene is not included in the list of smuggled goods issued.

Additional Collector Fayaz Anwar has dismissed the accused request for the release of their goods against the payment of redemption fine along with customs tax.

Meanwhile, AC Anwar has given the final judgement in the four seizure cases of smuggled Iranian plastic granules, in which he decided that the seized bags of plastic granules had been confiscated out rightly under Section 156(1)/89 of the Customs Act, 1969.
