Multan Adjudication directs M/s Zainab Duty Free (Pvt) Ltd to deposit Rs6.2mn in six installments

MULTAN: Collectorate of Customs Adjudication Collector has directed M/s Zainab Duty Free (Pvt) Ltd Multan International Airport to deposit duty and taxes of Rs6.2 million in six installments and imposed penalty of Rs10,000/-.

According to details, Assistant Collector Customs Bonds has formed contravention report against M/s Zainab Duty Free (Pvt) Ltd. Multan International Airport that accused was granted private customs bonded warehouse licenses bearing no.01/2016/BWH/MN and 02/2016/BWH/MN. Both licenses were issued on 19//05/2016 under section 13 of the Customs Act, 1969 for customs bonded ware house at Industrial Estate, Multan to run duty free business at International Airport Multan.

M/s Zainab Duty Free (PVT) Ltd. has imported certain consignments of Chocolate, Cosmetics, Perfumes and miscellaneous electronics of worth Rs.6.259 million. As per rule 350(2) of SRO 450(I)/2001, the utilization period of imported goods is two years from the date of import. The imported goods under duty free shop are allowed to sale for passengers against their baggage only.

But M/s Zainab Duty Free (PVT) Ltd. Failed to consume the imported goods within the stipulated period of two years from the date of in-bonding. The Collectorate has framed contravention against them after the expiry of Utilization period and asked them to deposit duty and taxes on the un-utilized goods. Counsel M/s Zainab Duty Free (Pvt) Ltd Asad Ali Malkana informed Collector Customs Adjudication that they have applied for renewal of their bonded warehouse license because after the expiry of license they could not sale any goods.

They further stated that they have also approached State bank of Pakistan for opening of bank accounts in Dollars as per condition but they refused.

Therefore responded stated that they may be allowed to clear the goods against the payment of leviable duty/taxes and requested payment in 12 equal installments. Collector Customs Adjudication accepted the reasons advanced by respondents are justified therefore case was disposed off with directions to pay the leviable duty/taxes six equal installment and penalty of Rs.10,000 has also imposed on the M/s Zainab Duty Free (Pvt) Ltd.
