KARACHI: The Directorate of Customs Post Clearance Audit (PCA) detected duties and tax evasion of Rs 14.69 million by two companies M/s Y C Pak & Co and Durdana Knitwear, it is learnt here on Monday.
Sources told Customs Today that M/s Y C Pak & Co located in Landhi imported a consignment of newspaper printing rile and photo copier and fax paper and got it cleared from the QICT Karachi vide GDs on October 22, 2017 by paying customs duty low at 7 percent after claiming the benefit of the SRO 558/2007.
However, the subject items were correctly classifiable under the PCT 2457.2107 attracting customs duty at 12 percent and income tax at 8 percent, thus, by way of mis-declaration of classification, the company evaded/short-paid Rs 6.54 million. The goods were cleared by Appraiser Raheel Waris..
Sources told that the importer violated the provisions of Section 47 (9-A) of the Customs Act-1969, Section 36 read with Section 74 of the Sales Tax Act-1990 and Section 69 of Income Tax Ordinance 2001 punishable under clauses (24) of Section 84(8) of the Customs Act-1969, Section 21 of the Sales Tax Act-1990 and Section 46 of Income Tax Ordinance 2001 and Section 9-A of the Sales Tax Act-1990 read with chapter X of the Sales Tax Special Procedure Rules 2007 (Special procedures for payment of sales tax by the importers) and under relevant provisions of Income Tax Ordinance 2001.
Sources told that another company M/s Durdana Knitwear imported a consignment of silk fabrics and American net fabrics got it cleared from the PICT Karachi vide GDs on December 29, 2017 by paying customs duty low at 10 percent after claiming the benefit of the SRO 568/2007.
The subject items were correctly classifiable under the PCT 5478.2907attracting customs duty at 14 percent and income tax at 10 percent, thus, by way of mis-declaration of classification, the company evaded/short-paid Rs 8.15 million. The goods were cleared by head examiner Mehmood A. Khan.
Both companies are directed to clear the outstanding dues at the earliest to avoid stern action.
