PCA files another FIR against M/s JP Construction and Trading Company due to mis-declaration

ISLAMABAD: Directorate General Post Clearance Audit (PCA) has unearthed one more scam of used prime movers and has launched third First Information Report (FIR) on the request of Appraising Officer Azeem Manzoor against the proprietor of M/s JP Construction and Trading Company Fahad Abdul Jabbar, a resident of Bilal Town, Sui Gas Road, Gujranwala , registered office Al Ghani industrial Estate, Lahore.

According to the details, Directorate General Post Clearance Audit has seized two used prime movers worth Rs 4.947 million.The  PCA has forwarded the case in the court of Special Judge Customs Islamabad for further legal proceedings. According to the FIR on 30th September 2016, the PCA had seized two prime movers of M/s JP Construction Company but goods had been cleared and released by customs and were seized while awaiting permission from M/s NLC.

Importer fraudulently got these used prime movers released from customs without establishing a bonafide  being a genuine construction company and without any verified construction projects, hence , without establishing the eligibility and entitlement to import these used prime movers in terms of para 9(ii) (5) of the IPO 2012-15, (the restriction and the restriction being that import of such used specialized vehicles was only allowed to genuine and bonafide construction companies.

The importer and other has committed fraud, mis declaration and smuggling in terms of sections 2(s), 16, 32 and 79 of the Customs Act 1969, read with SRO,556(1) 2005 dated 06.06.2005 and section 3(1) and (3) of the import and export (Control) Act 1960.
