PCT committee determines classification of ‘hydraulic hand pallet truck manual’

KARACHI: The PCT Committee of Model Customs Collectorate Appraisement-East has determined the classification of ‘hydraulic hand pallet truck manual’ under PCT Heading 8716.8090.

According to details, Chairman PCT Committee, Additional Collector-II Muhammad Tahir, in a PCT meeting, has determined the classification of hand pallet truck manual under PCT Heading 8716.8090 keeping in the view the facts and observations regarding “hydraulic hand pallet trucks/trolleys”.

It is pertinent to mention here that the matter relating to classification of “hydraulic hand pallet trucks/trolleys” imported by F M Qureshi and Company through GD No LAPR-HC-5350 was referred by the Customs Appraisement, Lahore for determining its correct classification.

In this regard, meetings of the committee were held on April 2, 2015 and April 14, 2015 wherein representative of the importers appeared and presented his view-point. However; the referring collectorate did not attend the meeting.

In the meeting, the representative of the importers argued that since hydraulic hand pallet truck-manual has structure to store the goods for transportation or in some types, that trolley or truck structure is equipped with the lifting/handling equipment, it therefore; falls under PCT Heading 8427.9000 as per Clause (b) of Para 2 of the General Rules for Interpretation (GIR) for classification.

The importer further said that the subject item was regularly cleared under the aforementioned PCT from Karachi ports and data in abundance was available.

The committee also examined the view point of the collectorate conveyed through its letter No V-Cus/Misc-076(IV)/2014/1211 dated January 24, 2015which shows that the Appraisement, Lahore has classified “hydraulic hand pallets truck-manual” under PCT Heading 8716.8090 on the basis of explanatory notes to HS Code 8716.8090.

Chairman PCT Committee, ADC Muhammad Tahir has finalized the PCT Heading of hydraulic hand pallets truck-manual under PCT Heading 8716.8090 while endorsing the Appraisement Lahore view point in this regard.
