KARACHI: Several importers have approached the Sindh High Court (SHC) against notices issued to them for appearance and joining investigation by Muhammad Tufail, investigation officer of Collectorate of Customs Enforcement & Compliance in smuggling of vehicles cases.
On 17 August 2021, counsels for the petitioners namely Nafees-Ur-Rahman, Muhammad Iqbal and others argued in their petitions that petitioners are the law abiding and peace loving citizen of Pakistan and attended the notables respect in the society and known as honest persons and respectfully.
They informed the court that Muhammad Tufail, investigation officer of Collectorate of Customs Enforcement and Compliance issued notices under section 156 of the customs act 1969 dated August 02, 2021 to the petitioners who are not possession holders or claimant of detained goods or vehicles except their real brothers.
Counsels stated that being aggrieved the petitioners has no other alternative, efficacious remedy is available under the law as no case under customs law or any other law has been braked by the petitioner nor petitioners were present at the place of incident from where goods and vehicles were seized hence these petitions are very much maintainable in the eyes of law.
Citing Secretary Revenue Division. Chairman Ministry of Finance, Chief Collector of Customs MCC Preventive, the Collector of Customs MCC Preventive and Muhammad Tufail as respondents, petitioners pleaded the court to act of the respondent who issue notices under section 165 of the customs act, 1969 to the petitioners be declared as illegal, viod, ab-intio and without jurisdiction.
They also pleaded the court to restrain them from taking any adverse action against the petitioners till final order in these petitions.
