SHC adjourns Custom Appraisement-West’s appeal against Saasa Corporation

KARACHI: The Sindh High Court (SHC) has adjourned hearing of an appeal filed by Customs Appraisement-West, challenging verdict of appellate tribunal over show cause notice issued to M/s Saasa Corporation for allegedly evading Rs 1.653 million tax.

A two-member bench, comprising Justice Munib Akhtar and Justice Saeeduddin Nasir, heard the appeal.

Earlier, counsel for the applicant stated that M/s Saasa Corporation had imported a consignment consisting of passenger lifts (loading capacity 1350kgs) and declared invoice value as $58,000.00, adding that after the payment of duties and taxes, the importer sought release of its consignment on less payment of revenue.

During examination of the goods, the actual weight was found as 44,430kgs, thus, there was deliberate concealment of weight of 18,830kgs with clear intention to get the consignment cleared on less payment of revenue and importer had made an attempt to evade legitimate revenue to the tune of Rs 1.653 million; therefore, a show cause notice was issued to the said importer. However, being aggrieved of the same, the importer filed an appeal before the appellate tribunal which accepted the appeal and set aside impugned show cause notice.

Citing M/s Saasa Corporation as respondent, applicant pleaded the SHC may declare that order of the appellate tribunal’s order is illegal and no legal effect. The department also pleaded the court may set aside impugned order of the tribunal and restore the proceedings of the department.
