SHC adjourns hearing of case filed by M/s Shashi Steel Pipe till first week of May

KARACHI: The Sindh High Court (SHC) has issued intimation notice with last chance to the applicant on a sales tax reference application filed by Commissioner Inland Revenue Zone-II RTO Hyderabad challenging impugned order passed by commissioner IR Appeals Hyderabad over recovery of Rs 40,326,372 from M/s Shashi Steel Pipe Works (Private) Limited. A two-member bench, headed by Justice Aqeel Ahmed Abbasi, was hearing to application.

During the hearing, the court observed that “no one was in attendance on behalf of the applicant and no intimation was received in-spite of services of court notice upon the applicant, therefore, as an indulgence and last chance, matter is being adjourned for a date to be fixed in the 1st week of May, 2017, office is directed to issue intimation notice to the applicant to be served through first three modes, failing which instant reference application will be dismissed for non-prosecution”.

Earlier, counsel for the applicant stated that a show cause notice was issued to the respondent for recovery of above mentioned amount, however, being aggrieved it filed an appeal before appellate forum which allowed its appeal in favour of the respondent without mentioning any lawful reasons. Therefore, SHC may pleaded that set aside impugned order of the CIR Appeals and restore its order.
