SHC allows reshipment of Anum Traders’ consignment

KARACHI: The Sindh High Court (SHC) has directed the tax authorities to allow the reshipment of consignment comprising 33,500 pieces of“Ku-band universal phh single,” which were wrongly shipped by the supplier. M/s Anum Traders had filed the petition seeking reshipment of the same goods seized by the tax authorities.

A two-member bench, comprising Justice Irfan Sadat Khan and Justice Muhammad Humayun Khan, was hearing the petition.

During the hearing, counsel for the petitioner submitted that petitioner is ready to furnish pay orders in the sum of Rs 1.664 million with the nazir of this court for release of his consignment. Therefore, the court directed the importer to submit pay orders before nazir of this court and tax authorities reship the said goods.

Earlier, the counsel stated that his client made contracts with foreign suppliers M/s Guangzhou Jiyi Industries and others, China for import of miscellaneous goods i.e electric goods, which are neither banned nor prohibited item as per import policy order. After formalities, the petitioner filed goods declaration dated August 13, 2015.

According to the petitioner, “Ku-band universal phh single LNBF, which were wrongly shipped by the supplier without intimating the petitioner which has been admitted by the supplier in its certificate.

Citing Federal Board of Revenue (FBR) chairman, Port Qasim Customs collector and Customs Intelligence as respondents, the petitioner pleaded the court may declare that act of the respondents is illegal, unlawful and mala fide and court may direct the respondents to allow the reshipment of the said goods with issue of delay certificate.
