SHC bars customs from auction of seized diesel, oil tanker

KARACHI: The Sindh High Court (SHC) has restrained the respondents from auctioning the oil tanker and alleged Iranian smuggled 19,000 liters of high speed diesel (HSD) until the appeal is decided before the Customs Appeals collector.

While hearing an application filed by Al-Mansoor Petroleum Services, the SHC division beach headed by Chief Justice Sajjad Ali Shah directed the collector to decide the pending appeal of the petitioner within 30 days. The court also directed the authority concerned not to put the oil tanker and diesel on auction during such period.

During the hearing, the petitioner’s counsel stated that against outright confiscation of his diesel the petitioner has filed an appeal before the Customs Appeals collector, which is pending but in the meantime the respondents intend to sell the oil tanker and diesel. The petitioner requested the SHC to restrain the respondents from auctioning the oil tanker as well as diesel till the verdict of the collector.

Earlier, the counsel stated that petitioner is a lawful owner of HSD of 19,000 liters (approximately) load on of oil tanker but respondents claimed that they intercepted the oil tanker at Tool Plaza Mirpur Khas Road and confiscated the said diesel and tanker on the charges of illegal Iranian smuggled oil. According to the petitioner, the oil was purchased by M/S Hascal Petroleum Ltd after fulfilling all the requirements.
