KARACHI: The Sindh High Court (SHC) directed customs department and deputy attorney general of Pakistan to file their comments on a constitutional petition filed by M/s R/H Enterprises against detention of consignment of 498 rolls of textile fabrics weighing 13790 kg imported from New York.

On 5 March 2020, a two-member bench, headed by Justice Aqeel Ahmed Abbasi was hearing the matter.

During the hearing, counsel for the petitioner stated that petitioner has imported goods 498 rolls of textile fabrics weighing 13790 kg from New York, and submitted goods declaration, and the said cargo has been stopped by the customs on the basis of valuation and the same has been kept in bounded warehouse.

He further submitted that it is pertinent to bring to the gracious notice of this court that the value determined by the customs valuation department was very high than actual price. The actual price of the goods is US$ 10,901 whereas the customs assessed unexpected and unbelievable value of US$ 1,24,600 knowingly and deliberately with their ulterior motives.

Citing Ministry of Revenue, Chairman FBR, the Sectary Revenue Division, The Chief Collector of Customs MCC Appraisement South, Chairman Federal Tax Ombudsman and the Collector of Customs MCC Port Qasim as respondents, petitioner pleaded the court may direct the concerned respondents to release the consignment forth with after taking the customs duties on the value of US$ 10,901 which was given by the petitioner, as it is actual value of the consignment.

He further pleaded the court may direct the respondents who valued the consignment US$ 124,600 sold out the goods either departmentally or in general public at the above noted amount and paid only the amount of US$ 10,901 and the remaining amount deposited for national exchequer and give benefit to our beloved country.
