SHC calls explanation from counsel for M/s Safe Life Private Limited

KARACHI: The Sindh High Court (SHC) issued an intimation notice to Mushtaq H Qazi advocate, counsel for the respondent on a reference application filed by Commissioner Inland Revenue Zone-II, RTO III, challenging the impugned order of the appellate tribunal over recovery of Federal Excise Tax of Rs2.7million from M/s Safe Life Private Limited.

A two-member bench, comprising Justice Aqeel Ahmed Abbasi and Justice Muhammad Arshad Khan, was hearing the reference application.

During the hearing, counsel for the applicant submitted that on last date of hearing when notices were issued to the respondent, Mushtaq H Qazi advocate voluntarily appeared and undertook to file power on behalf of the respondent whereas he is not in attendance. After the arguments, the court issued an intimation notice to Mushtaq H Qazi advocate for the next date who shall explain his position as to why, after having given undertaking to file power on behalf of respondent, needful has not been done so far, so the court adjourned the hearing for third week of March2017.

Earlier, counsel for applicant stated that M/s Safe Life is a franchise of M/s Telenor Pakistan Private Limited and a show cause notice was issued to the respondent for recovery of federal excise duty of Rs2.7million, however being aggrieved, the respondent approached appellate tribunal and filed an appeal against its impugned show cause notice which was granted.

Citing M/s Safe Life Private Limited as respondent, the applicant pleaded with the court to declare the order of the appellate tribunal illegal and unconstitutional and suspend the same.
