SHC customs officials to conclude arguments on petition filed by M/s Goldway Hygiene

KARACHI: The Sindh High Court (SHC) has directed customs officials to conclude their arguments on a constitutional petition filed by M/s Goldway Hygiene Products, challenging enhancement of valuation of a consignment of non-woven (raw material for diaper) imported from China. A two-member bench, comprising Justice Munib Akhtar and Justice Omer Sial, heard the petition.

Earlier, counsel for the petitioner stated that he imports non-woven (raw material for diaper) from China and has imported above mentioned goods cross weight 23,830.10kg unit price @ $2.10 and filed Goods Declaration (GDs) according to the law.

He submitted that after filing Goods Declaration, the petitioner paid Rs 2,108,977 as duty and taxes accordingly, however, the petitioner is seriously aggrieved by the act of the respondents who determined the unit price value @ $2.10 to $4.10 illegally and without lawful authority.

Citing Chairman Federal Board of Revenue, Collector of Customs Collectorate of Appraisement, Director General Directorate General of Customs Valuation and other as respondents, petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary, he also pleaded the court may restrain them from charging extra amount over duty and taxes on its consignment.
