SHC directs IR chief to decide appeal of M/s Pakitex in a month

KARACHI: The Sindh High Court (SHC) directed the Commissioner Inland Revenue Appeal-II to decide the appeal of the petitioner within four weeks on a constitutional petition filed by M/s Pakitex Boards Private Limited against the impugned show cause notice for recovery of disputed amount issued by the tax department.

A two-member bench, comprising Justice Aqeel Ahmed and Justice Muhammad Arshad Khan, was hearing the petition.

During the hearing, learned counsel for petitioner submitted that Instant petition can be disposed of with the direction to the Commissioner Inland Revenue Appeal-II to decide its appeal within a reasonable time. After his arguments, court disposed of petition with the direction to the respondents not to force petitioner for recovery of impugned demand, and directed to Commissioner Inland Revenue Appeal-II to decide the appeal and stay application within four weeks.

Citing Sectary Ministry of Finance, Chairman Federal Board of Revenue, Commissioner Inland Revenue Appeal-II, Deputy Commissioner Inland Revenue E & C Unit-III & IV Zone-II LTU and Assistant Commissioner Inland Revenue Large Taxpayer Unit as respondents, petitioner pleaded with the court to restrain them from taking any coercive action against the petitioner till final disposingl of this petition.
