SHC directs M/s Luck Traders’ counsel to attend court seeking release order of consignment

KARACHI: A two-member bench of the Sindh High Court (SHC), comprising Justice Shah Muhammad Siddiqui and Justice Agha Faisal directed counsel for the petitioner make sure his appearance before the court on next date of hearing on a constitutional petition filed by M/s Luck Traders.

On 2 November 2021, during the hearing, Kafeel Ahmed Abbasi deputy attorney general of Pakistan, Hussain Bohra assistant attorney general of Pakistan, Masooda Siraj Advocate for customs department appeared before the court, however, no one appeared on behalf of the petitioner.

After the hearing, the court directed counsel for the petitioner to attend the court for the next date of hearing. Earlier, counsel for the petitioner submitted in his constitutional petition that petitioner is engaged in the lawful business and always fulfill all the legal requirements, and during the course of business, petitioner imported a consignment of bicycles and filed goods declaration under valuation ruling no 1300/2018.

Counsel added that petitioner’s consignment was held by the officials of the customs department without lawful authority.

Citing Secretary Revenue Division, Collector of Customs Appraisement, Deputy Collector of Customs Appraisement Port Muhammad Bin Qasim as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

Counsel further pleaded the court may direct them to release petitioner’s consignment on provisional release and restrain them from taking any adverse action against the petitioner till final order in this petition.
