SHC directs tax authorities to file comments on petition filed by M/s Siddiq Sons

KARACHI: The Sindh High Court (SHC) has directed tax authorities to file para wise comments on a constitutional petition filed by Siddiq Sons Tin Plate Limited against impugned demand notice of Rs 23.488 million in the respect of duty and taxes. The court also directed both parties to maintained status quo till the next date of hearing.

A two-member bench, comprising Justice Munib Akhter and Justice Anwar Hussain was hearing the constitutional petition and fixed the hearing for September 6, 2016.

Earlier, the counsel for the petitioner stated that petitioner is engaged in the manufacturing of tin plate employing about 250 local workers and imports raw material for processing and converting it into tin plate.

According to the petitioner, officials of the Customs Collectorate Gwadar, Gaddani issued a notice dated August 2,2016 to the petitioner, whereby petitioner has been directed to pay Rs23.488 million duty and taxes relating to the goods declaration  (ST) dated 18/04/2012 on goods which have not been actually imported.

Citing chairman Federal Board of Revenue (FBR), Collector of Customs  ( appeals ), Deputy Collector of Customs Model Customs Collectorate, Gwadar, Gaddani and Deputy Collector  ( bonds ) Model Customs Collectorate, Gwadar, Gaddani as respondents, Petitioner pleaded the SHC may set aside impugned demand notice dated August 02, 2016 and direct the respondents from taking any coercive action against the petitioner.

Petitioner also pleaded that court may declare that act of the respondents illegal, malafide, unjustified.
