KARACHI: The Sindh High Court (SHC) directed customs officials to release the consignment of galvanized steel coils of secondary quality on bank guarantee on a constitutional petition filed by importer Naveed Tahir against detention of his consignment due to disputed valuation.
On 8 April 2020 a two-member bench, headed by Justice Aqeel Ahmed also issued notices to customs officials and directed them to file their respective para wise comments on next date of hearing.
During the hearing, counsel for the petitioner argued that petitioner is engaged in the lawful import of steel products and in the normal course of business of the petitioner has imported a consignment of galvanized steel coils of secondary quality and filed goods declaration according with law, however, high officials of customs department detained his consignment without showing any lawful reasons which act against the constitution of Pakistan and customs laws.
He submitted that petitioner has moved an application for provisional release, however, customs officials also declined the application and petitioner has no option but approach this court for remedy.
Citing chairman Federal Board of Revenue, collector of Customs Collectorate and others petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and direct them to release his consignment immediately and restrain them from taking any coercive action against the petitioner till final order in this petition.
