SHC directs to release consignment of M/s Gerry’s Globe Trade after securing differential amount

KARACHI: The Sindh High Court (SHC) directed officials of customs department to release imported consignment of the petitioner after securing differential amounts on the shape of bank guarantee/ pay order on a constitutional petition filed by M/s Gerry’s Globe Trade.

On 16 February 2022 a two-member bench, headed by Justice Irfan Sadat Khan heard the matter.

During the hearing, counsel for the petitioner argued that matter in on urgent basis, therefore, court may grant urgency.

After the hearing, court granted urgency and passed directions that “learned counsel states that the petitioner has imported above mentioned goods and filed goods declaration according to law, however, customs officials detained the same without shown any lawful reason and authority.

He added that petitioner is ready to submit bank guarantee, therefore, court may direct customs officials to release petitioner’s imported goods.

After the hearing court passed order and observed in its order that in view of the facts and circumstances of the case, we directed the customs authorities to release the goods imported by the petitioner subject to the condition with the petitioner will deposit undisputed amount within seven days and with regard to disputed amount postdated cheques with endorsement from the banker clearance for payment with the nazir. with these directions this petition disposed of along with listed application”.

Citing Chairman Federal Board of Revenue, Director General of Valuation, Director Valuation, Collector of Customs Appraisement & Facilitation East as respondents, petitioner pleaded the court that petitioner imported mobile accessories of low and brand assorted brands including computer data cable, earphone unpacked form, mobile speaker, multimedia, tower speakers. Mini remote etc legally.

He further pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary as well as may direct them to release petitioner’s imported goods as well as restrain them from taking any adverse action against the petitioner till final order in this petition.
