SHC directs to restore NTN, ID of M/s Kazi Corporation as per law

KARACHI: A two-member bench of the Sindh High Court (SHC) headed by Justice Irfan Sadat Khan directed customs officials to restore NTN/ID number on a constitutional petition filed by M/s Kazi Corporation.

Dated 22 January 2022, during the hearing, Umar Farooq advocate for petitioner, Khalil Rajpar advocate for customs officials and Kafeel Ahmed Abbasi, deputy attorney general of Pakistan appeared before the bench.

During the hearing, counsel for the petitioner argued that matter is on urgent basis, therefore, court may allow urgency and hear the matter.

After the arguments, court allowed urgency and passed on order that learned counsel states since the petitioner has been acquitted vide judgment dated May 06, 2021 passed in SCRA No 4/2019, hence the license of the petitioner may be restored.

Learned counsel for customs department has not objection this behalf. The respondents/ department therefore is directed to restore the license of the petitioner in accordance with law keeping in view in order passed by the licensing authority dated Fed 27, 2019, petition stands disposed of in the above-mentioned terms.

Earlier, counsel for the petitioner argued that customs officials has fixed allegation against the petitioner that M/s First Way Link Traders in collusion with clearing agent M/s Kazi Corporation and others has submitted fake and fabricated E-Forms meaning thereby foreign exchange amounting to US$ 3, 345,380 as not remitted in the country.

Citing Chairman Federal Board of Revenue, Additional Collector of Customs Licensing, Customs Appraisement West, Chief Collector of Customs Appraisement South as respondents, petitioner pleaded the court to declare that fixation of the allegation by customs department is unlawful, mala fide and arbitrary.

He also pleaded the court to restore his NTN/ ID Number and restrain them from taking any adverse action against the petitioner till final order in this petition.
