KARACHI: A two-member bench of the Sindh High Court (SHC) directed customs officials to shift the imported consignment to CPF Bond in accordance with rules and requirements on a constitutional petition filed by M/s Q. M Metals seeking release order for imported aluminum cable cutting scrap seized by the customs department due to disputed valuation.
On 17 November 2021, during the hearing, Ghulam Nabi advocate for petitioner, Kafeel Ahmed Abbasi deputy attorney general Hussain Bohra, assistant attorney general, Tariq Aziz, principal appraiser, Port Muhammad Bin Qasim appeared before the court and made their arguments.
After arguments, court disposed of the petition with direction that “on the last date of hearing, the scope of this petition was limited to the extent of prayer clause “a” i.e shifting of the goods to CPF Bond, although show cause has already been issued to them and they would exhaust their remedy available to them under the law.
However, for the time being in order to save them for financial losses including detention charges, their submission is that a goods may be moved to CPF Bond, to which we have not heard anything substantial to deny such relief, from the respondents side, hence, to such a limited scope of this petition.
We have considered the request as they intend to exhaust the remedy available to them under the law and till such time such remedy is exhausted, the goods be shifted to CPF Bond in accordance with rules and requirements, petition stands disposed of along with pending applications”.
Citing Chairman Federal Board of Revenue Division, Collector of Customs Adjudication and Customs Port Muhammad Bin Qasim as respondents, petitioner pleaded the court to direct them to release imported consignment and restrain them from taking any adverse action against the petitioner till final order in this case.
