KARACHI: A two-member bench of the Sindh High Court (SHC) dismissed a constitutional petition as not pressed filed by M/s Ihsanullah & Co seeking release order for imported 18 vehicles which were seized by customs officials.
On 23 December 2021, during the hearing, Muhammad Ayaz Advocate for petitioner, Kafeel Ahmed Abbasi deputy attorney general of Pakistan, Hussain Bohra assistant attorney general of Pakistan attended the court.
Muhammad Khalil Dogar advocate appeared and filed vakalatname of behalf of customs department, during the hearing, counsel for the petitioner argued that matter is on urgent basis and petitioner also has moved an application for urgent hearing, therefore, court may take up this case.
After the hearing, the court granted an urgent application, attorney for the petitioner present in person and showed his original power of attorney which was seen and returned. He does not press this petition, accordingly, the same is dismissed as not pressed along with pending applications.
Earlier, counsel for the petitioner argued that petitioner had imported 18 vehicles and filed goods declarations according to law, however, customs officials seized the same without showing any lawful reason.
Citing Chairman Federal Board of Revenue, Deputy Collector of Customs Hyderabad, terminal manager, dry port and others, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
He also pleaded the court to direct them to release petitioner’s imported consignment and restrain them from taking any adverse action against the petitioner till final order in this petition.
