SHC dismisses petition filed by M/s New Hamdard Medicine

KARACHI: A two-member of the Sindh High Court (SHC) dismissed a constitutional petition as not pressed along with all pending applications filed by M/s New Hamdard Medicine over dispute printed logo in Urdu and English language Halal Products.

On 25 January 2022, a two-member bench, headed by Justice Irfan Sadat Khan heard the matter.

During the hearing, Sardar Faisal Zadar advocate for petitioner, Shahab Imam for customs department and Kafeel Ahmed Abbasi deputy attorney general of Pakistan appeared before the bench.

During the hearing, counsel appearing for petitioner undertakes instructions of his client and withdraws the intend petition which is dismissed as withdrawn along with all pending applications.

Earlier, counsel for the petitioner argued that petitioner has imported cologrin sweetening, KRU Sugarel, KRU Sugared, KRU Edul Reb. A Sugarel, KRU Sugarel 1200ER and others which has contravened of the IPO the import policy condition that is the Halal logo, that food products shall be printed in Urdu and English language on the consumer packing.

However, customs officials created objections that under SRO 438(1)/2019 are not importable without ingredients and details of the products of the foods products shall be printed in Urdu and English Language on the consumer packing and a show cause notice was issued to the petitioner.

Citing Chairman Federal Board of Revenue, Collector of Customs Appraisement East, Collector of Customs Appeals, Chairman Classification Committee, Secretary Ministry of Commerce as respondents, petitioner pleaded the court to declare kindly a distinction between the edible & food supplements and thus kindly be made in terms of the SRO 412(1)/2014 which declare foods supplements as drugs 236(1)2019 in this regard is not applicable and goods may kindly be release
