SHC dismisses petition filed by M/s Rabia Enterprises seeking release of consignment

KARACHI: A two-member bench of the Sindh High Court (SHC) has dismissed a constitutional petition filed by M/s Rabia Enterprises seeking release order for imported consignment of dry battery cells seized by customs officials due to higher valuation instead of declared.

On 13 September 2021, a two-member bench, comprising Justice Shafi Muhammad Siddiqui and Justice Agha Faisal heard the matter.

During the hearing, counsel for the petitioner argues that concedes that he would first avail the remedy to the concerned department where he has already moved an application before filing of this petition.

After the hearing, the court passed an order that” accordingly instant petition being misconceived stands dismissed along with listed application”.

Earlier, counsel for the petitioner stated that during the course of business, petitioner imported a consignment dry battery cells and filed a goods declaration according with law and requested customs officials for release the imported consignment, however, petitioner was informed by the staff that above mentioned consignment was seized by the customs officials due to disputed valuation.

He further stated that goods are being evaluated under the garb of valuation ruling no 1514/2021 which is totally against the law and no legal effect.

Citing Chairman Federal Board of Revenue, Chief Collector of Customs Appraisement East and others as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

Counsel further pleaded the court may direct them to release petitioner’s consignment immediately and restrain them from taking any adverse action against the petitioner till final decision in this petition.
