SHC dismisses petition seeking release order of imported vehicles

KARACHI: The Sindh High Court (SHC) has dismissed a constitutional petition filed by Fahad Ali, Gull Faraz, Zamin Abbas and others against detention of their Honda, Suzuki Every, Daihatsu Boon and other vehicles, imported by petitioners as per policy of gift scheme.

On 8 September 2021, a two-member bench of the Sindh High Court (SHC) comprising Justice Shafi Muhammad Siddiqui and Justice Agha Faisal heard the matter.

Court mentioned in its order that “this petition was fixed on June 1, 2020, whereafter, it was fixed on September 23, 2020, when counsel for the petitioners was called absent, even today there is no one in attendance on behalf of the petitioners and there is no intimation either.

It appears that petitioners have lost interest in the proceedings, accordingly, petition is dismissed for non-prosecution along with listed applications”.

Earlier, counsel for the petitioners had stated in his petition that, petitioners have imported different types and brands’ vehicles as per policy of gift scheme, however, their vehicles have been seized by the customs officials and show cause notices were issued to the petitioners.

Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector of Customs Port Muhammad Bin Qasim, Deputy Collector of Customs Port Muhammad Bin Qasim and others, petitioners pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

Counsel further pleaded the court to set aside impugned show cause notices and direct them to release their imported vehicles and restrain them from taking any adverse action against the petitioners till final judgment in this petition.
