SHC fixes case hearing of petition filed by M/s Attractive International against detention of imported goods

KARACHI: The Sindh High Court (SHC) directed counsels for petitioner and customs department to come prepare and give their arguments on a constitutional petition filed by M/s Attractive International challenging enhancement of valuation of imported consignment of ceramic & porcelain under valuation ruling no 874/2016.

On 5 October 2021, a two-member bench, comprising Justice Shafi Muhammad Siddiqui and Justice Agha Faisal heard the matter.

During the hearing, Imran Iqbal Advocate for the petitioner requested that since this is a covered case, it may be fixed on October 08, 2021.

After the hearing, the bench adjourned the hearing and directed the office to fix this case for Oct 8, 2021.

Earlier, counsel for the petitioner argued that petitioner is doing lawful business of import of above-mentioned goods and never has been involved in any criminal or tax evasion case.

Counsel argued that during the course of business, petitioner imported above-mentioned consignment and filed goods declaration according with law, however, petitioner was informed that goods were enhanced 12/5% under the garb of valuation ruling no 874/2014 which is already totally illegal, mala fide and arbitrary.

Citing Secretary Revenue Division, Chairman FBR and Collector of Customs Appraisement West as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

Counsel further pleaded the court to direct them to release petitioner’s consignment immediately and restrain them from taking any adverse action against the petitioner till final order in this petition.
