SHC fixes date of hearing on petition filed by M/s ECO Powergen challenging inquiry

KARACHI: The Sindh High Court (SHC) fixed Oct 28, 2021 as date of hearing on a constitutional petition filed by M/s ECO Powergen against detention of its imported consignment of Diesel Generator Fuel Filter seized by customs officials and also show cause notices for re-opening of old inquiry for recovery of duties and taxes.

On 3 September 2021, during the hearing, counsel for the petitioner appeared before the court and requested the court to fix the date of hearing of this matter. After the hearing, the court fixed Oct 28, 2021 as a date of hearing and adjourned the matter.

During the hearing, counsel for the petitioner argues that petitioner is engaged in lawful import of Diesel Generator Fuel Filter and during the business, petitioner has imported the same and filed goods declaration.

He further argues that however, petitioner came to know that customs officials issued two different impugned notices dated June 04, 2021 and July 13, 2021 for reopen past and closed transaction inquiry without any justification and no legal effect.

Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Director General of Directorate General of Port Clearance Audit South, Director of Directorate of Port Clearance Audit South and Deputy Directorate of Port Clearance Audit South as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.

Counsel further pleaded the court may restrain them from taking any adverse action including blocking of its NTN/WeBOC, user-ID till final order in this petition.
