KARACHI: A two-member bench of the Sindh High Court (SHC) granted urgency and fixed November 8, 2021 for hearing of a constitutional petition filed by Shaikh Muhammad Naeem seeking auction of goods comprising lots weight 500MT of board sweeping consisting of old and used iron & steel strips, lashes etc.
On 3 November 2021, during the hearing, Riaz Ahmed Phulpoto appeared on behalf of the petitioner and argued that matter on urgent basis, therefore, the court may proceed this case on urgent basis.
After the hearing, the court fixed November 08, 2021 as a date of hearing and issued notices to the customs officials and deputy attorney general of Pakistan.
Counsel added that petitioner through auction bearing highest bidder got the lots weight 500MT of board sweeping consisting of old and used iron & steel strips, lashes etc and fulfilled all the legal formalities and paid all the amount which were required.
Counsel argued that now it was known that customs officials without any reasons and legal authority have cancelled the delivery of the above-mentioned auction goods which are property of the petitioner.
Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector of Customs Appraisement East, Assistant Collector of Customs Appraisement East, Deputy Tariff Manger East, Wharf KPT, Karachi as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
Counsel added that court to direct them to release petitioner’s legal goods and restrain them from taking any adverse action against the petitioner and also restrain them to sell the above mentioned goods to others.
